Verdicts

As of January 2025, there have been two verdicts in favor of the plaintiffs. In 2025 Paragon expects there will be many more favorable verdicts.
Margo Gill — Missouri
In July 2024, a Missouri jury awarded $495 million to Margo Gill and her family after her infant developed NEC after consuming Similac formula. The jury found that Abbott Laboratories failed to warn about the increased risk of NEC for premature infants. The trial centered around the claim that Abbott Laboratories knew about the risks associated with their formula but did not provide adequate warnings to parents and healthcare providers. The plaintiff’s lawyers presented evidence from scientific studies showing a link between cow’s milk-based formulas and NEC in premature infants. The jury awarded $400 million in punitive damages and $95 million in compensatory damages.
Jasmine Watson — Illinois
In March 2024, an Illinois jury awarded $60 million to Jasmine Watson and her family after her infant developed NEC after consuming Enfamil formula. Similar to the Missouri case, the jury found that Mead Johnson did not provide adequate warnings about the risks associated with its product. The trial involved the claim that Mead Johnson knew about the increased risk of NEC in premature infants but failed to warn parents and healthcare providers. The plaintiff’s lawyers presented evidence from long-standing studies and expert warnings linking cow’s milk-based infant formula to a higher likelihood of NEC. The jury awarded the plaintiff $25 million more than she initially sought.
